1. Introduction
Welcome to Asiatique Voyages! By accessing our website at www.AsiatiqueVoyages.com, booking a tour or service, or making any purchase, you agree to be legally bound by the following Terms & Conditions. If you do not agree with any part of these terms, please refrain from using our website or services.
These terms apply to all visitors, users, customers, and others who wish to access or use the website and services of Asiatique Voyages.
2. Bookings and Payments
Booking Process
By submitting a booking request, you agree to these Terms & Conditions. All bookings are subject to availability and are not confirmed until you receive written confirmation from Asiatique Voyages.
Payment Requirements
A deposit or full payment, as specified for your tour, may be required to confirm your reservation. The remaining balance is due no later than 30 days prior to the tour departure date, unless otherwise stated.
Accepted forms of payment include credit card, PayPal, or any other methods listed on our website. Failure to pay the balance by the due date may result in cancellation without refund.
Late Bookings
For bookings made within 30 days of departure, full payment is required at the time of booking.
3. Cancellations and Refunds
Cancellation by the Client
All cancellations must be made in writing via email to: info@asiatiquevoyages.com.
Cancellation fees are calculated based on the date we receive your notice:
* More than 60 days before departure: 70% refund of total payment
* 30–59 days before departure: 50% refund
* Less than 30 days before departure: No refund
* All deposits are non-refundable
Cancellation by Asiatique Voyages
We reserve the right to cancel any trip due to low enrollment, safety concerns, force majeure, or other unforeseen circumstances. In such cases, you will receive a full refund of payments made to us. However, we are not responsible for any additional expenses incurred, including but not limited to flights, visas, or insurance.
Non-Refundable & Unused Services
The following are strictly non-refundable:
- Flights not booked through us
- Travel insurance
- Visa & service fees
Third-party services unless a refund is granted by the provider
No refunds will be issued for any unused portion of a tour once it has commenced, including meals, accommodations, or transport. No refunds are available for delays or disruptions due to adverse weather, unless the entire tour is canceled.
4. Passports, Visas & Insurance
Travel Documentation
It is your responsibility to ensure you possess valid passports, visas, and any other required documentation before departure. Entry requirements may vary by destination and are subject to change.
Entry Denial
Asiatique Voyages is not liable if you are denied entry due to insufficient documentation or failure to comply with applicable entry requirements, including health regulations.
Travel Insurance
We strongly recommend purchasing comprehensive travel insurance, including coverage for trip cancellation, interruption, medical emergencies, evacuation, and baggage loss. Consult your insurance provider for details.
Proof of insurance may be required before trip commencement.
Health Advisories
Stay informed on travel advisories and health regulations, including vaccinations and COVID-19 requirements. Asiatique Voyages bears no responsibility for any disruption caused by non-compliance.
5. Force Majeure
Asiatique Voyages is not liable for delays, changes, or cancellations caused by force majeure events such as natural disasters, wars, terrorism, strikes, civil disturbances, epidemics, pandemics, government actions, or other circumstances beyond our control.
In such cases, refunds are not guaranteed. However, we will attempt to recover and return any recoverable costs from our suppliers, less any non-refundable or administrative charges.
6. Liability Disclaimer
Third-Party Suppliers
We act as an intermediary between you and third-party service providers (e.g., hotels, airlines, transport operators). We are not responsible for acts, errors, omissions, or negligence of these providers.
No Ownership or Control
Asiatique Voyages does not own or operate the independent providers used in your travel arrangements.
Limitation of Responsibility
We are not responsible for any loss, injury, delay, or damage to person or property resulting from circumstances beyond our control, including but not limited to acts of God, theft, illness, or equipment failure.
7. Traveler Conduct
Code of Conduct
We reserve the right to remove any traveler who is disruptive, abusive, intoxicated, or acts in a way that endangers others or disrupts the group. No refund will be issued in such cases.
Responsibility for Additional Costs
Removed travelers are responsible for all costs associated with early departure, including transportation, lodging, and meals.
8. Medical Conditions & Accessibility
Disclosure Requirement
You must inform us in writing at the time of booking of any physical, medical, or mobility conditions that may impact your ability to travel.
Accessibility
We will attempt to accommodate your needs but cannot guarantee availability of ADA-compliant services or facilities, especially outside the U.S. Travelers with disabilities must travel with a paying companion capable of assisting them.
9. Photo & Video Release
By participating in an Asiatique Voyages tour, you grant us permission to use photographs or video likenesses taken during the tour for marketing and promotional purposes without compensation or further approval.
10. Jurisdiction & Governing Law
These Terms are governed by the laws of the State of Wyoming, USA. You agree that any dispute will be brought exclusively in a court of competent jurisdiction located in Wyoming. Use of this website is unauthorized in any jurisdiction that does not give effect to these Terms.
11. Class Action Waiver & Notice of Claim
You agree to resolve any disputes individually and waive your right to participate in any class action lawsuit. Asiatique Voyages shall not be liable for punitive damages. A typewritten notice of claim must be submitted to us within 30 days of tour completion or cancellation to be considered.
12. Entire Agreement & Severability
These Terms, along with any written communication such as invoices or confirmations, represent the entire agreement between you and Asiatique Voyages. If any part of this agreement is deemed invalid, the remainder shall remain enforceable.
